Definitions

"Services" means the professional organizing and consulting services offered by SUSANIZE (as described in our separate Consulting Agreement);

"Content" means all text, images, logos, graphics, and materials on the Site;

"You" or "User" means any person accessing or using the Site.

1. Use of Site

You agree to use this Site only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use of this Site by any third party. Prohibited uses include, but are not limited to:

· Using the Site for any fraudulent or unlawful purpose

· Attempting to gain unauthorized access to the Site or its systems

· Transmitting viruses, malware, or other harmful code

· Harvesting or collecting data from the Site using automated means

· Impersonating any person or entity

All content on this Site, including text, graphics, logos, and images, and the KonMari® trademark, is the property of SUSANIZE, Marie Kondo, or their respective licensors,and is protected by Singapore and international copyright and trademark laws. You may not: reproduce, distribute, modify, or create derivative works from any content without prior written permission; use any Content for commercial purposes without a licence; remove or alter any copyright, trademark, or other proprietary notices.

The KonMari® name and logo are registered trademarks of Marie Kondo and are used by SUSANIZE under licence. Unauthorized use is strictly prohibited.

Limited Licence: We grant you a limited, non-exclusive, non-transferable licence to access and use the Site for personal, non-commercial purposes only.

3. Consulting Services

If you engage SUSANIZE for professional organizing services, those services are governed by our separate SUSANIZE Consulting Agreement, which you will be required to sign before services commence.

These Terms of Use apply only to your use of this website. In the event of any conflict between these Terms and the Consulting Agreement, the Consulting Agreement shall prevail with respect to the provision of services.

4. Limitation of Liability

The information on this Site is provided for general informational purposes only. While we make reasonable efforts to ensure accuracy, we do not guarantee that the content is complete, current, or error-free.

To the fullest extent permitted by Singapore law:

(a) We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement;

(b) We are not liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the Site, including but not limited to loss of profits, data, or opportunities;

This limitation does not apply to liability that cannot be excluded by law, such as liability for death or personal injury caused by our negligence, or liability for fraud or fraudulent misrepresentation.

We do not control and are not responsible for the content or privacy practices of these external sites. You agree to indemnify, defend, and hold harmless SUSANIZE, Susanne Strahberger, and our respective officers, employees, agents, and service providers from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

(a) Your use of the Site in breach of these Terms;

(b) Your violation of any applicable law or regulation; or

Your violation of any third-party rights, including intellectual property rights.

6. Governing Law

These Terms of Use are governed by and construed in accordance with the laws of Singapore, without regard to conflict of law principles.

If a dispute arises out of or in connection with these Terms:

(a) The parties will first attempt to resolve it through good faith discussions; and

(b) Failing resolution within 30 days, the dispute shall be subject to the exclusive jurisdiction of the Singapore courts.

7. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified or removed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

8. No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. No waiver on one occasion shall be deemed a waiver on any subsequent occasion.

9. Changes to Terms

We may update these Terms at any time. If we make material changes, we will post a notice on the Site with the updated "Last Updated" date. Your continued use of the Site after such changes constitutes acceptance of the updated Terms. We recommend reviewing these Terms periodically.
